Vermont IEP Deadlines: The Overview Every Parent Should Know

Vermont's special education process has its own real deadlines, set out in the state's own Board of Education rules alongside federal law. Here's the actual timeline.

Initial evaluation: 60 calendar days

Vermont requires the initial evaluation to be completed and the report issued within 60 calendar days of the date you sign consent -- Vermont's rules define "day" as a calendar day unless stated otherwise. Eligibility is determined by the team based on that evaluation, not a separate, later clock. (Vt. State Bd. of Educ. Rule 2362.2.1(c))

IEP development: 30 days after eligibility

If your child is found eligible, Vermont requires the IEP team to develop the IEP within 30 days of the eligibility determination. (34 C.F.R. § 300.323(c)(1); Vt. State Bd. of Educ. Rule 2363.1)

Annual review: at least once every 12 months

The IEP team must review, and revise if needed, the IEP at least once every 12 months. (34 C.F.R. § 300.324(b)(1)(i))

Reevaluation: at least once every 3 years

A full reevaluation is required at least once every 3 years, unless you and the district agree it's unnecessary. (34 C.F.R. § 300.303(b)(2); Vt. State Bd. of Educ. Rule 2362.2.3)
